The Soft Exchange: The Soft Exchange is a non-profit national computer User's Group. Membership is free and automatic for all users of any of our services. We are dedicated to providing an inexpensive used software and hardware clearinghouse. We provide a service for those who wish to acquire (or sell) computer software (or hardware) conveniently; and virtually without risk. We also market and distribute Macintosh public domain and shareware software at a national level. We offer the unique ability for members to acquire software of their choosing on an inexpensive, pay per item, basis. The Soft Exchange is an enterprise devoted to providing quality distribution services, at levels and prices unavailable anywhere else. ========================================================== Used Commercial Software, How it Works: - Those wishing to sell programs send them to The Soft Exchange. - Programs are immediately entered into the appropriate catalog (according to computer compatibility) of available software. - Catalogs are available in paper form and on Macintosh disk. Catalogs are also available and updated as necessary on the GEnie computer network. Catalogs are always named "SOFTEX.CAT" in all computer software libraries of GEnie. Catalogs will soon be available on the Apple-Link computer network. - Those wishing to buy software can contact The Soft Exchange by writing to us; leaving letters on the GEnie computer network; or calling. Upon receipt of clear payment for a program, it's sent to the buyer. - Within 14 days after a program is sent to a buyer, a check will be sent to the seller for the seller's asking price less a 20% commission. Requests for Software or Hardware not Currently in Stock: - Requests for software or hardware will be place in the catalog for one month (free of charge). - Requests will be removed before the one month limit at the requester's request. - What's requested today, may not be requested tomorrow. - A "bid" price is helpful if included with requests. Buying a Program: Write: Simply send the name(s), version number(s), and catalog number(s) of the software you wish to purchase and a personal check or money order for the program╒s selling price plus shipping and handling charges to: The Soft Exchange 106 Cove Lane, #55 Rossford, OH 43460 Or Call or Leave a Message on GEnie to Reserve a Program: Please state an intent to buy, which program (including the catalog number), and your name and address. The program will then be reserved for a catalog. If, by the time of the second catalog update, payment is not received, then the software will again become available for transfer. (Please note that it is not necessary for you to do this, just an option.) Call: (419) 661-9374 Any (Reasonable) Time GEnie Mail: T.CONSTANTIN - Please add $3.00 shipping and handling for the first program ordered, ($4.00 for Alaska and Hawaii) and $1 for each additional program. - The program(s) you ordered will be sent immediately for money order payment, or in about 2 weeks for personal check. - Express, C.O.D., and Canadian immediate shipping is available upon request, and for $5 additional charge. - Please read the "Fine Print" at the end of this document - All sales are final except in cases of software failure. In this case the buyer has 14 days from shipment date to contact The Soft Exchange to notify us that the software is defective. Specific problem description must accompany reports. Credit towards future purchases are given for defective software. System requirements are published in the catalog and are not a basis for dissatisfaction. Remember, all software is checked for defects before shipment. - Items are subject to availability. If the item requested is currently out of stock, and the buyer has sent a check for a specific item, then the buyer may be placed on a waiting list for the next available program, at his or her request, or payment will be returned. Either way the buyer will be immediately notified of the order╒s status. Selling a Used Commercial Program: - To sell a program simply send the original program(s) in working condition, any documentation, and the Software Submission Form at the end of this document to: The Soft Exchange 106 Cove Lane, #55 Rossford, OH 43460 - It is vital that we receive a program before placing it in our catalog to insure that it is the original copy and that it is in working order. A receipt for your program(s) submitted for sale will be sent to you. - Upon receipt of an order and clear payment for your program(s) a check from The Soft Exchange will be sent to you for the selling price, less commission charges. If you send more than one program, a separate check will be sent as each program is sold. - Commission: all programs received after September 30, 1988 will be subject to a new, straight 20% commission charge, with a $4 minimum charge for each program. (I hope you agree this makes more sense than the old commission schedule). All programs received before September 30 fall under the old commission schedule, as agreed. As always, no commission is charged, and the software remains the property of the seller, until after the program is sold. - If you wish to modify terms of this agreement, such as selling price or decide you don╒t wish to sell the program(s), please notify us in writing and your requests will be processed expeditiously (shipping and handling costs may be applied for returned programs, these costs will not be excessive). - Again, please make certain the software remitted is the original copy, includes original documentation, and is in working condition. Fine Print: - It is not an infringement of the copyright laws to sell, or otherwise vend a particular copy of a program for which the seller has acquired legal title. All rights and privileges of ownership of title, however, will transfer to the buyer. - According to Federal Copyright Law: when selling a program all backups of the program(s) must also be remitted or destroyed. Also, if the program has been modified, the seller must have the authorization of the copyright owner to transfer the program. - It is the full responsibility of the seller and the buyer to ensure that he or she is complying with applicable federal copyright laws, state license enforcement laws, as well as applicable.license agreements of the transferred program. It is assumed each principle is complying, or agrees to comply, with the law. - The Soft Exchange acts as an agent, we do not take title to any program or it's license in this exchange service. We disclaim any warranty against infringement of federal law, state law, and/or license agreements by either the seller or the buyer. We further disclaim any warranty of title with respect to the programs. - These are very general statements about a very complicated matter of software copyrights. They are not absolute or guaranteed. More information is available upon request. - Trademarks, Tradenames, and Copyrights herein belong to their respective companies. Marketing these products will be done directly (as with software) or indirectly (with catalog classified advertisements). Classified Advertisements for Used Hardware: Classified ads for used hardware can be placed in the appropriate Soft Exchange catalog (according to computer system compatibility). Ads will be available in blocks of 35 words (or less), and running a maximum of 2 months. These ads will be $10/block. The 35 word maximum is for the body of the ad. Name, address, and phone number(s) of the seller will not be counted, but included free of charge. Please send your advertisement; name, address, and phone number(s) where interested parties can contact you; computer system compatibility and/or requirements; and check or money order to: The Soft Exchange 106 Cove Lane, #55 Rossford, OH 43460 Direct Marketing of Used Hardware: We will also direct market hardware at a seller's request. This will be basically the same service we offer in our marketing of used software. The seller first sends us the hardware (of which he has legal title) and hardware description. We will then market it, deal with prospective buyers, guarantee condition of the hardware to buyers, and guarantee payment to sellers. The seller retains title, and no commission is due, until after the item is sold. The hardware will be sold at the seller's asking price plus appropriate shipping and handling charges. Upon clear sale of each item a check for the selling price, less commission, will sent to the seller. Hardware will be marketed by The Soft Exchange until it is sold, or requested to be returned. A commission of 10% of the selling price will be charged for this service, with a $10 minimum charge. Interested parties should send their hardware, asking price, and hardware descriptions to the above address. ========================================================== Apple and Macintosh product catalogs will soon be available to users on the "Apple-Link" computer network.
